A steel fabricator has secured damages after his foot was crushed in an accident at work.
His employer had instructed him to weld together a skid for use in the mining industry. However, he was not given appropriate instructions on how to carry out this highly complex task. The accident happened when he and a colleague were attempting to move a metal plate into position using an overhead crane. The plate fell from the crane and came apart, and a plate weighing around 250kg landed on his foot.
He suffered a severe crush injury, fracturing three metatarsals. He has difficulty managing at work and continues to experience pain when it is cold.
He brought a claim against his employer, which disputed liability for the accident. After court proceedings were issued, however, his claim was settled for approximately £15,000.
