£40,000 Compensation for Chlorine Gas Exposure on Holiday

A holidaymaker who developed asthma after she was exposed to chlorine gas at her hotel has obtained compensation.

She was on holiday in Portugal when the incident occurred. She was overwhelmed by a cloud of chlorine gas while using the hotel's pool facilities. An ambulance was called and she received treatment at the scene before being taken to hospital.

She needed further hospital treatment after her return to England, and was diagnosed with asthma caused by the exposure to chlorine. She also suffered psychological injuries.

She brought a claim under the Package Travel and Linked Travel Arrangements Regulations 2018, which allow people who suffer injury or illness while on a package holiday to pursue a claim in the UK against the package holiday provider. The provider denied liability, claiming there had been no breach of local safety laws.

Court proceedings were issued and expert advice was obtained on the relevant laws in Portugal. Medical evidence of the effects of the incident on her was also assembled. Damages of £40,000 were subsequently secured.
