Compensation has been secured for a door and window fitter who suffered a serious injury when a drill fell from a nine-metre ladder onto his leg.
He was working on the door of a house when he knocked a ladder that was standing nearby. A drill fell from the top of the ladder, where it had been left by a colleague, and the drill bit went into his calf.
He spent three nights in hospital. After his return home, his mother moved in with him as he needs daily support. He was left with nerve damage and now walks with a limp. He may never fully recover from his injuries. The accident has also affected him psychologically.
He brought a claim against his employer, arguing that it had failed to take steps to ensure his health and safety, such as providing suitable protective equipment. His employer admitted that it had failed in its duty of care to him by not providing a safe place of work and, following negotiations, a settlement of £90,000 was agreed.
