Compensation has been awarded to a five-year-old boy who injured his leg while on a package holiday abroad.
The boy and his family were using the pool at their hotel when he slipped near the edge of the pool, catching his leg on the brickwork surrounding it. He sustained a 1.5cm laceration below his kneecap. Stitches were inserted, but the wound became infected and he needed further treatment after returning to the UK.
As a result of the infection, it took four months for him to recover completely. His injury affected his ability to take part in PE for two weeks, but his attendance at school was otherwise unaffected. He was left with a small scar.
A claim was brought against the package holiday provider on the basis that it had failed to ensure that the premises were safe for visitors. Following negotiations, a settlement of £1,500 was agreed. The settlement was subsequently approved at a court hearing.
