A holidaymaker who injured his leg when he tripped and fell at the hotel where he was staying has obtained compensation from the travel company that provided his package holiday.
The man was staying at a resort in Jamaica. He tripped on uneven wooden decking at the bottom of some steps and fell to the ground. He visited a medical centre and an X-ray revealed that he had broken his foot. He required further treatment after returning to the UK.
He brought a claim under the Package Travel and Linked Travel Arrangements Regulations 2018, which allow people who suffer injury or illness while on a package holiday to pursue a claim against the package holiday provider in the UK. However, the travel company initially denied liability.
Medical evidence was obtained to provide a detailed prognosis of his injury. He had also taken photographs of the decking to show that it posed a hazard. The travel company made an offer to settle the claim before court proceedings began and, following negotiations, a settlement of £5,500 was agreed.
