Compensation has been obtained for a girl who suffered a life-changing brain injury in a road accident.
The girl, who was nearly three years old, was hit by a taxi in the road outside her home. She suffered a severe traumatic brain injury and was left with physical, cognitive and behavioural difficulties.
A claim was commenced against the driver of the taxi, who initially denied liability on the basis that the girl had suddenly run into the road and there had been no time to avoid a collision. However, an agreement was reached whereby damages would be assessed on the basis of 80 per cent liability.
Interim payments were obtained, allowing specially adapted accommodation to be purchased for the girl. Following negotiations, a settlement of her claim was agreed. She will receive a lump sum of £6.25 million and payments of £300,000 per year for life. The damages will allow her to receive the specialist care she is likely to need for the rest of her life.
