In a case on point, a farm worker who suffered life-changing injuries when he fell backward from a lorry loaded with hay received multi-million-pound damages.
The middle-aged man was rendered paraplegic by the spinal injuries he suffered in the fall and, as a result of the accident, lacks the mental capacity required to manage his own affairs. After proceedings were launched on his behalf, the relevant farm's insurers swiftly admitted liability for the accident.
Following negotiations, the insurers agreed to pay a £2.7 million lump sum, together with six-figure, index-linked annual payments to cover the costs of the man's care and case management for life. The total capitalised value of the settlement was conservatively estimated at between £5 million and £6 million.
Approving the settlement, the High Court praised both sides for their cooperative approach to settling the case. The man's sensible, intelligent and helpful daughter had lavished unstinting care upon him and given great assistance during the settlement process.
