Serious injury claims fees and funding

The majority of serious injury claims we handle are funded on a ‘no win, no fee’ basis, as this avoids the need for our clients to worry about how they will fund their claim or any financial risk involved.

With a no win, no fee serious injury claim, you will sign a ‘conditional fee agreement’ or ‘CFA’. This states that there is no upfront cost to start a claim and you won’t owe us a penny unless we succeed in winning compensation for you.

In some cases, other forms of funding may be more appropriate e.g. trade union funding for workplace injury claims (if you are a trade union member).

We will be happy to talk through your options for funding a serious injury claim during your free initial consultation with our team.

Serious injury claim time limits

You normally have three years to make a claim for a serious injury or any other type of personal injury.

Exactly when this time limit is counted from will depend on the circumstances, but it is generally the date on which you were aware you were injured due to someone else’s negligence or deliberate action (known as the ‘date of knowledge’). This may be significantly later than when the injuries actually occurred.

There are also various exceptions to the standard three-year time limit that may apply, depending on the situation.

Head over to our personal injury claims page to find out more about time limits for personal injury claims.

What you can claim for and how much you can claim

The level of damages you can claim for a serious injury will reflect the impact on your health, finances and other areas of your life.

You can commonly claim for issues such as:

  • Financial losses due to your injuries – including lost wages, the cost of paying for treatment, specialist equipment etc.
  • Expected future financial losses – e.g. reduction in your future earning potential, the need to pay for ongoing care etc.
  • Loss of amenity – i.e. no longer being able to carry out activities you previously could, such as driving, playing sport etc.
  • Pain and suffering – for your physical and emotional pain.

Our South Wales serious injury lawyers will talk you through the potential damages available and give you a realistic estimate of what may be achievable during your initial consultation with our team.
